Guidelines on the organization of work for district (city) and regional courts during the emergency situation are updated 14.05.2020
The Minister of Justice Jānis Bordāns have approved the updated guidelines with regard to organization of work of district (city) courts and regional courts during the emergency situation, in order to eliminate risks for health of visitors of the court as well as staff of the court and to adjust the work of courts to the precautionary measures determined in the state.
The guidelines provide that a court shall ensure examination of cases by a written procedure as much as possible. Oral court hearings shall be organized remotely in case if it is not possible to examine the case by a written procedure. If the examination of the case is not possible either in writing or remotely, then the court hearing should be held in presence, upon ensuring the restrictions determined by the Cabinet of Ministers with regard to gathering indoors and taking into account the restrictions determined for convoying of arrested persons, in cases, being related to significant violation of rights of the person and objective urgency or other cases, with a purpose to prevent or minimise accumulation of cases, establishing during the emergency situation.
It is determined that the chairperson of the court shall supervise the number of court hearings planned at the same time in the building of the court, their timings and the number of involved persons, making sure on the possibility to ensure the restrictions determined by the Cabinet of Ministers with regard to gathering indoors.
Representatives of mass media and listeners, who have applied for participation in presence in an open court hearing accordingly through the public relations specialist of judicial authorities of the Court Administration, may be admitted to the court hearing, if it is possible to ensure the restrictions determined by the Cabinet of Ministers in relation to gathering indoors. Participation should be also applied for if the court hearing is planned remotely.
Secretariats of courts will also further on basically not accept and not issue any documents to private persons in presence (including on the issues of the Land Register) during the emergency situation. Court documents will be notified by using a mail (selecting the regular postal item, unless the law provides otherwise), e-mail or online system (in cases determined by law).
It is possible to submit the documents to the court via mail, electronically as well as through online system, as well as by leaving them in a special mailbox outside the court (at the point of leaving of documents).
The Ministry of Justice recommends to carefully treat health of yourself and peers and to responsibly treat the determined precautionary measures.
